Terms of Service

Pixnesto (the “Service”) is operated by [Company legal name], a company registered in [Country of incorporation] with its registered office at [Registered office address] (company number: [Company registration number], tax registration: [GSTIN / VAT number]), referred to as “we”, “us” or “our”.

These Terms form a binding agreement between us and the person or business that creates a studio account (“you” or the “Studio”). If you accept these Terms on behalf of a business, you confirm you are authorised to bind it.

• You must be at least 18 years old and give accurate sign-up information.
• You are responsible for keeping your password safe and for everything done through your account, including by team members you invite.
• Tell us promptly at [support@pixnesto.com] if you suspect unauthorised access.

Pixnesto helps photography studios manage enquiries, quotes, shoots, crew, client galleries, invoices, payments and expenses. We may improve, change or remove features over time. If we remove a feature that is central to a paid plan, we will give reasonable notice.

• Free plan. Free of charge, with usage limits shown on our pricing page, and supported by advertising shown inside your studio workspace.
• Pro plan. Priced for your country and shown in your local currency on our pricing page, billed monthly or yearly in advance through our payment partners, Razorpay for domestic INR Pixnesto subscriptions. Client online payments are unavailable at launch.. Subscriptions renew automatically until cancelled. You are billed in the currency of your studio’s country at the price shown when you subscribe.
• Prices exclude taxes. GST, VAT or sales tax is added where it applies to you, and we issue an invoice for every payment (a GST tax invoice in India). Add your GSTIN, VAT number or other tax ID in Settings to have it shown and, where the law allows, to apply the reverse charge.
• We may change prices with at least 30 days’ notice by email. A change applies from your next billing period after the notice ends.
• If a payment fails, we will retry and notify you. If it remains unpaid, your studio moves to the Free plan and content over the Free limits becomes read-only. It is not deleted (see section 8).

Cancellations and refunds are covered by our Refund & Cancellation Policy.

On the Free plan we show a small number of clearly labelled advertisements inside your studio workspace. We never show advertisements on anything your clients see, including galleries, quotes, invoices, payment pages and emails, and we never share your clients’ personal data with advertisers. The Pro plan has no advertisements.

You own the photos, documents and data you upload or create (“Your Content”). You give us a limited licence to host, store, process, resize and display Your Content only as needed to run the Service for you, including showing galleries to the people you share them with.

You confirm you have the rights and, where required, the consent of the people concerned to upload Your Content and to store your clients’ personal data in Pixnesto. For your clients’ personal data you are the controller (the “data fiduciary” under India’s Digital Personal Data Protection Act, 2023) and we are your processor under data protection laws such as the EU and UK GDPR and the DPDP Act; our data processing terms form part of these Terms. You agree not to use the Service to:

• upload content that is unlawful, infringes someone else’s rights, or depicts anyone without consent where consent is required;
• send spam or messages your clients did not ask for;
• attempt to break, overload, reverse engineer or gain unauthorised access to the Service; or
• resell the Service without our written permission.

We may suspend accounts that break these rules, and will tell you why unless the law prevents us.

• We do not silently delete client galleries. Before any deletion we warn you by email and give you time to export.
• You can export your clients, shoots, invoices, payments and expenses at any time, on any plan.
• If you close your account, we delete Your Content within [number] days, except records we must keep by law (for example tax invoices).

When you collect payments from your clients through Pixnesto, the payment is processed by Razorpay for domestic INR Pixnesto subscriptions. Client online payments are unavailable at launch. under its own terms, and the contract for your photography services is between you and your client. You are responsible for your prices, taxes, refunds and disputes with your clients.

We work hard to keep Pixnesto available and your data safe, but the Service is provided “as is”. Keep your own copies of original photographs; Pixnesto is a delivery and business tool, not your only backup.

To the extent the law allows, we are not liable for indirect or consequential losses, lost profits or lost data, and our total liability in any 12-month period is limited to the amount you paid us in that period. Nothing in these Terms limits liability that cannot be limited by law.

You can stop using Pixnesto and close your account at any time from Settings. We may end or suspend the Service for you if you seriously or repeatedly break these Terms, with notice where reasonable.

These Terms are governed by [Governing law, e.g. the laws of India]. Courts at [City and country of the courts] have jurisdiction. If you are a consumer, this does not take away protections you have under the mandatory law of the country where you live. Before going to court, please write to us so we can try to resolve the issue.
